Q: 90 days stayence, 1 year visa. 4 days past 90 day stamp, but visa not expired

I live in hubei province, booked a return ticket to Toronto, but it leaves 94 days after my last stamp from Beijing. I really don't want to travel to hong kong to get the stamp then back up to bejing. My visa doesn't really expire until December. Would I get trouble in customs?

Yes, you must exit, no choice. Someone else can correct me if I'm wrong but I believe every extra day you stay after 90 days is a 500 RMB fine.

Make a trip to the PSB, show them the ticket and request an extension. I am sure they would probably help you as this is a minor issue. I do not think you will be fined for just 4 days, probably just warned, but you might get a bad mark on your record. This could complicate future visas.

Expect to get pulled by Immigration.

 

Depending upon the officer's mood, if he is about to knock off, hungry, your fengshui, whether he got lucky last night or a list of other things, you may:

a) just walk through,

b) get a fine and leave (and a possible "don't come back in a hurry" stamp)

c) detained just long enough to sort it out so that you miss your flight

d) you may be staying for a few weeks longer than expected at the Big House.

 

In any event, your next visa, should you want one could be problematic.

Go to the exit and entry bureau and ask there. Otherwise, don't risk it. Aside from the fine, this could seriously damage your future visas. Get a Chinese friend to help you ask. otherwise, would the cost of changing the ticket be less than a trip to Hong Kong? you could try changing it, it might still save you money.

A stupid question from me.......knowing the length of stay of your visa why did you book a flight that leaves 4 days after your length of stay?

Yeah, it's 500 RMB per day that you're here illegally, up to a maximum of 5000, I think.

 

This happened to me (sans trip), so I went to the PSB and explained that I was having trouble understanding the rules, and that I am very, very sorry if I caused any problems. I requested an extension and they gave me one.

GuilinRaf posted here that the best thing to do is immediately turn yourself in, and explain that you're very sorry, etc. That's if you're already past the date.

 

If you're not past the required date yet, which you don't seem to be, then please go to the PSB and tell them that you couldn't find a plane ticket within the correct exit date, and request an extension. They'll help you.

 

You may get a warning. I was warned, but there was no mark on my record; I can re-enter China any time.
