Q: bad school problem

I have been working at a training centre in Qingdao for 3 months.

 

The first month they had a probationary period of 6000 rmb, things seemed fine.

 

Afterwards the second month they were

suppose to pay me 8000 rmb, but they only paid me 6000 rmb.I kept asking wheres the money they didnt give me an answer.

 

They paid me late and next payday is 7 days later.If they shortchange me again or dont pay on time what should i do my options

i have the fec/legal rp.

 

And if want to leave go back to my country for vacation can i keep my visa without reapplying for an new visa as my cousin is deeply ill. 

 

also how can i keep my fec/rp intact and get my last salary.

Check your contract carefully to see how and when the salary is supposed to be paid.

email your company outlining clearly the problem with your salary, including late payment: get a Chinese friend to translate the same content into Chinese so they can not claim lack of understanding.

it the company does not respond within 24 hours, ask them, by email, for the address of your local SAEFA office.

8000 rmb and 26th of every month. but they only paid me 6000 rmb out of 8000 rmb last month wages.

You can keep your RP, if your employer doesn't respect Contract. 'Late or no' salary is Contract breach, what is reason for resignation.

1. Find new employer, who can sponsor your RP. New School must be 'authorized to employ FT'.

2. Visit SAFEA (Foreign Expert Bureau) in the city you're working. I guess in Qingdao, there's somebody at SAFEA, who speaks and understands English. Tell SAFEA, 'you don't want to work at your present School anymore'! Tell them, you have new School, and you want to resign immediately!' It is important, you find new employer before that!

3. Give your present employer Resignation notice! Make 2 copies, one for SAFEA.

4. SAFEA will help you in retrieval of Release letter, Cancellation certificate of FEC, documents necessary for RP extension, and last salary.

 

FEC is not that important, however don't give your FEC to your present employer till you don't talk to SAFEA!!

If you change your employer, new employer must apply for new FEC with (old) FEC cancelation certificate.

If you want to go home, I suggest you talk about (unpaid) leave with your new employer.

Look what your Contract says about salary. If in Contract is written, your salary will be 8000 Rmb after 30 days probation period, School must pay you that amount! If not, School is in Contract breach.

how to find safea address and details.

and what will safea do for a foreign teacher.

and what would be the schools reaction and how can i negiotate unpaid leave with my school.

You can ask your present boss: 'Can you tell me please, where is SAFEA?'

You might not get an answer from your boss, but things at your School will improve immediately!

 

You can go to the Bank, where you hold an account. Bank in China have at least one person with passable English. You can ask them to help you with SAFEA's address and location.

 

SAFEA is the same office, where you get your FEC. Your employer took you there, and you had to give them 2 photos.

 

SAFEA is usually in big Government building with loads of flags outside. Public Security Bureau is probably in the same building, so you were there in the first two weeks of your arrival to Qingdao.

Your record at the present School should be good. No 'missing classes' 'drunk' and similar things. SAFEA will talk to your School.

That's not always the point of responding.  The answers help other expats too.  No offense Engl Ted, but you seem to be one of those guys just here to criticize other posters.  This is like the third time I've seen you do so. 

 

As far as the question goes:

Two things I did.  1. You can legally terminate the contract immediately for not enrolling you in Social Insurance.  2. Find the labor bureau that is in charge of the district where your workplace is located and tell them your boss has not enrolled you.  Then, sit back and watch as they bust your employer for numerous offenses.  All you need is one legitimate excuse for the Labor bureau to conduct an inspection.  They will find 50 offenses.
