Q: Can i be arrested for not providing my employer with a resignation letter?

On the 1st of April I had a dispute with my employer over my tax with holding as it is my understanding that I am suppose to get a paer stating that my taxes and social insurance premiums have been paid. Afterwards the school started telling me that if I do not give them a resignation letter that they will inform the authorities who will have me arrested, fined, and deported. It is my understanding that they want to terminate me and not have to be able to prove that they had cause. Likely because I am asking too many questions.

Not really arrested ... but, you might have difficulties to obtain new Working permit.

I don't have real experience with it ... but, you are required to  give Resignation notice to your employer in 30 or 90 days before your last working day as per your Contract.

On the other hand, your employer is required to give Release letter (to you or to your new employer) in 30-days after your last working day.

With Release letter, you can change employer without exiting China and applying for new Working permit and Z visa.

These are terms from Chinese Labour law.

As I can see, you have several questions with similar topic, I would direct you to SAFEA, Chinese governmental org. which is entitled to issue/approve foreigner's Working permit beside many other things/permits.

You can get SAFEA's address and phone number in different provinces on our weblink.

Type 'SAFEA' in search bar above for the web link.

Displayed ''SAFEA's" are provincial headquarters where you will most likely get in touch with English speaking Chinese agent.

Good luck!

Don't know, but if you're working on a business visa as you mentioned in your other post you can get arrested for that.

A: "... through ..."?  Only "through" comes to mind is "Shenzhen agent can connect you with an employer, who's authorized to hire waigouren ... and can sponsor Z visa." It's not like every 10th person you meet in Shenzhen's hood can sponsor work visa ...  The only way to change from student to labourer visa is just a regular way by: 1. Finding an employer, who'll apply for an Invitation letter; 2. Exit China and apply for Z visa in your home country's Chinese embassy; 3. Enter China in 30-days after Z visa was stamped into your travelling instrument ...As I am aware, you won't be able to switch to Working permit by remaining in China....,so make ready for a return to your home .... -- icnif77
