Q: Can I leave my language school for another job without losing my z visa?

My school has given me a contract which they seem to think is not worth following.  I am half way through my contract.  I want to move on but I do not want to return to my home country to get another visa.  Am I stuck until the end of my contract?  I have heard that only the original employer can renew a visa without going home.  Is there another way?

Z visa get converted to Residence permit, and it expired in 30 days after you entered China.

- Find new School/RP sponsor.

- Get one (or more) Contract violation by your employer, and state them in the Resignation notice. After you handed RN, you must respect RN period. 30 - 90 days, depend on your Contract.

- Visit SAFEA in the city, and ask them for advice and guidance. Most likely, you will need SAFEA later to help you recover necessary documents and salary from your old School.

When School is in the Contract breach, you can change employer, and keep your RP intact.

Your new School should be authorized to hire FT, and able to extend your RP. You don't need to exit China (new Z).

the resignation period stated in the contract is only to follow if you wanna quit your job and they did NOT break the contract.

if they broke your contract then you can leave the next day but you shouldnt be as bad as them and give them maybe some time to rearrange their schedule.

as far as I know they also have to give you a release letter

I agree! I made mistake in my reply above.

When School is in Contract breach, you don't need to respect Resignation notice. You can walk away next day.

Please what is SAFEA ?

icnif77:

State Administration of Foreign Experts Affairs or Foreign Expert Bureau, which issues Foreign Expert Certificates to FT.

yes you can.

just transfer your work permit and resident permit under new school.

1 cancel the work permit of your previous school

2 then apply for the work permit under the new school.

3 go to interview in public securtity bureau

4 got approved and then got the approval result

5 apply for the resident permit in public security bureau.

of course, the premise is that your resident permit doesnt expire . still have at least one month to process i suggues.

Best Regards

Chester

A:Good question!  I'd say, if you study at Uni in China beside working full-time as an E.T. with Residence permit, you don't interfere with your full-time employment. It's your free time and you can do anything you want, with respect to the Chinese laws and customs. Have a look at terms of Z visa/Residence permit and ... ".. you cannot work (and earn monies!) with another employer ..."That's all it is! Your RP sponsor title is written on the RP stamp in your passport, I think. It's in Mandarin, so I've heard about that from someone ...At I.D.-ing by cops, they know where you work and than more details about you are just a phone call away ... and it happened in person ... LOL ... during the day-time stroll through Wulumuqi, Xinjiang, 2012/13 semester. Now under RP, you're free to surf Internet, jog, ... and study, too. I suggest, you look and ask at the Uni, you plan to study in the future. Have a detailed look at requirements for studying and attending chosen Uni.Good luck! -- icnif77
