Q: I have lost passport with expired visa

I have lost my passport two days after expiration. I made my new passport 73 days later. How much penalty I have to pay, if it's the first time I got my visa expired, and I have all documents from my embassy and 出入境。

To let your visa expire Feruza may be regarded as a misfortune, to lose both your passport (as well) looks like carelessness

75 days overstay? Did you report the loss of your passport after two days overstay or when you got a new one?

If after 75 days then you'll be looking at the amount that Robk suggests and possibly administrative detention for 5-10 days!

ironman510:

It will be Y10,000 and possibly a 72 hour jail sentence while they investigate.

Only 72 hours? That American father & son a year or 2 back for something like 5 & 10 days each. Though I think they were also done for working illegally.

I see, our friend who worked at Meten English went over his visa by 30 days in Shenzhen because he honestly misunbderstood the exit instuctions. He was held for 2 days and paid 10,000 than left China and came back with a new visa after he got a new Passport in HK, but that was 2011, the less strict days. So yeah it could be much much longer then 72 hours for over staying 2 months. The PSB never will buy his passport story.

Yeah I think the fine is capped at 10K but for some ridiculous period of time like 75 days they might take further action.

Did you do anything to head this off at all? Like go to the PSB and say your passport is lost?

This seems like a weird post. You lost your passport after it was already expired. Then waited probably around 2 full months to even apply for a new passport which you received on day 73? What did you do in the meantime...just not worry about it?

You've stayed in China illegally for 75 days? Awesome. That's quite some feat. They'll probably give you a little present and a mildly insulting note with various grammar and spelling mistakes.

But seriously. You're fucked. It seems that after a browse on Reddit the penalty is around 500 RMB a day. Which makes your penalty currently in the vicinity of about 37,500 RMB. They probably have a cap on it at around 10,000 but who knows? It'll be fun for you to find out.

I do believe your question borderlines your imagination. You see, a couple of years ago a close friend got her passport stolen, and asked me for help, so I accompany her during the whole process. First we had to go to local Police to file a complaint. With that we went to PSB and they provided a document stating her to have a visa to be in China. Then went tpo her Embassy, and with the required documents from local Police confirming theft and PSB confirming visa, she requested a new passport and got it. Once she had her new passport, she exited China with documents from PSB without a problem, and went home to request a new visa. She had to pay no fines at all.
Now, why do you claim to overstay your visa if you followed the existing rules?

Hotwater:

My understanding of the OP's post was that they'd already overstayed two days when they lost their passport. Then 73 days later they had a new passport and possibly an exit. USA from the PSB. Unfortunately there is a lack of information for what happened between losing passport and getting a new one.

Though the bottom line line is they shouldn't have even overstayed two days as that's a stupid thing to do.

Hotwater:
Your interpretation of what was posted could be right, but I read it a bit different.
To me, "I have lost my passport two days after expiration" means that it was lost two days after the passport expired. No mention of a visa expiration at all. And by the tine the new passport arrived, it was 73 days later. Now, if it was an American passport, the rules for replacing the lost passport includes notification of local Policde and PBS. And PBS should have issued a temporary visa and exit permit, so no overstay.
But as you well said, not much info is offered, so we are making assumptions

Hotwater:

You're right, difficult to fully understand the situation. I made my comments based on the question headlong "I have lost my passport with expired visa" and the first paragraph.

Though based on history of this site we'll never know as the OP will probably not come back with more details as it's possibly a made up question.

And, although it's only been 2 days, the OP hasn't returned. Which I'd think a bit odd if it was something THIS important! (unless, further information has been obtained - in which case, we'll probably never know!)

If it was a genuine account and question, and assuming the poster hasn't been locked up or something in the last two days, you would think he or she would have been online participating in the conversation given the situation.

You will be sent to the detention centre (jail) for about 4-6 weeks if you can't pay the fine. Years ago, in 2012 I overstayed and they fined me 5,000RMB. I don't know what the penalty rate is these days. It could have changed.

@bradley99 above, were you not also banned/excluded from re-entering China for a number of years also?

This is the automatic addition to deportation, so how long were you banned for?

Well since the OP is almost a year old. I'm guessing Feruza has already dealt with it, paid the fine or whatever and moved on with his life.

That's assuming Feruza is actually real of course which I doubt. A quick look at his profile shows one post, 361 points and he has been an ECC member since 1970. Before the internet.

When you go back digging up posts a year old you really have to assume the poster's situation has changed somewhat.

A: "... through ..."?  Only "through" comes to mind is "Shenzhen agent can connect you with an employer, who's authorized to hire waigouren ... and can sponsor Z visa." It's not like every 10th person you meet in Shenzhen's hood can sponsor work visa ...  The only way to change from student to labourer visa is just a regular way by: 1. Finding an employer, who'll apply for an Invitation letter; 2. Exit China and apply for Z visa in your home country's Chinese embassy; 3. Enter China in 30-days after Z visa was stamped into your travelling instrument ...As I am aware, you won't be able to switch to Working permit by remaining in China....,so make ready for a return to your home .... -- icnif77
