Q: Can I change my mind about a job offer while a work permit is being processed?

I have been offered a job and I think the work permit is being processed. However, I am considering another post. Is it possible to change - how long does the processing of a work permit take? If I do not go through the residency permit procedure, do I still need a release letter?

Depends on the stage. ( I do visa's for our teachers so I know:

 

1. If your stage is at "Notice of Working Permit." The school can simply go online and cancel it, it'll be canceled within 48 hours ( Business days.)

 

2. If you've already gone with your HR to the Permit office for "in-person check" of your documents than you've already finished the Working permit card, it'll be released within 2 to 3 weeks.

 

So if #2 happens, you have to follow you contracts "resigning" agreements, the Permit office has no control after they give you the card.

 

If you resign and the school agrees, the school will simply cancel the card online and send you a PDF copy to your wechat or email and get a release letter, thus start looking for a new job.

No, you cannot change your mind (unless force majeure or similar ..) because you signed a contract with your WP sponsor, and with signed contract they applied for your WP.

Signed and stamped contract is a requirement for WP application.

 

That signature of yours is binding and you aren't advised to renegade on that unless you are very ill and ...

You'll need very, very good excuse why you won't respect the signed contract ...

 

It's difficult to say what will happened to you, if you'll sign contract with another school. 

I'd say, Working permit at new employer will be rejected and you'll experience similar problems at every new employer in the future in China. 

 

I don't have such an experiences, but I believe they (Chinese governmental agencies) hold a record ... on such and similar laowai's contract violations.

I would wait until the work permit and residence permit is issued and then you could give your notice to resign from the position. The only catch is that the employer could give you difficulty in leaving the position. They would have to apply for a work permit cancellation receipt from the government and issue a release letter. If they refuse and if you have done nothing wrong you could take them to arbitration. Please get in touch for specific information if needed.

Once you are on the system and the work permit is being processed you cannot apply for another position unless they cancel your current application.
