Q: How to report illegal workers (teachers)?

Hello,

 

I wish to know which government department I would go to report a training center employing illegal workers? On July 12th, I am going to the PSB to pick up my passport. Do I tell them? This place has people in it from France, Spain Brazil and other places. Clearly illegal.

 

The government is already jumpy because the international G20 is coming. I have my personal reasons for doing this. From all the hoopla about "crackdowns" on illegal foreign workers, there hasn't seem to be too much in enforcement of the laws. Pretty simple for an officer to go undercover, pay for a few classes, and clearly see that some of the instructors could not have Z visas, because they would be disqualified based on their nationality.

 

so, who would be the agency who would listen for violations of the law?

report the license plate if you see him/her throw a lit cigarrette out the window and follow the vehicle and stay with it until the police show up and be sure to attend the future proceedings to be sure that your allegation is followed through with appropriately

I know some illegal English teachers who ran from a police when's the police made regular checks. Illegal ones who are caught needs to pay some penalty and probably they will be deported. I think some local police will be interested if you report.

This is a no brainer. Do it. Less illegal teachers working in China the better I say. It's not a surprise that it suppresses the wages of the teachers who are actually here legally. Every single teacher that is working here legally should be upset about illegal teachers working in China, because it is harming your value.

 

In fact, I even think many non native speakers shouldn't be teaching English regardless of a degree in an English speaking country or not. It's become entirely too easy to obtain a bachelor's degree in an English speaking country today. Universities have very little credibility today. International students are just a money making scheme for most of them.

What business of yours is it to report illegal workers?

 

If it's to get one over on the training centre I could understand it but what you're suggesting here is that you're going to get other foreigners in possibly very BIG trouble. Minimum would be a fine, possibly up to 20k RMB. Worst case could be a similar sized fine, 10-14 days IN JAIL and then deported.

 

KEEP YOUR NOSE OUT!

Firstly, that's a pretty big assumption that they're working illegally! A - the new laws haven't yet come into effect, and they may have a legit visa based on previous regulations!!!

 

Secondly, the provisions allow for non-native speakers to teach if they have a degree from a university in an  English speaking country (I know a Spaniard, a couple of Poles, a Hungarian and a Lithuanian (and a Mexican or 2) who are legally teaching here! And, we have a couple of others in this board who also are NNES and legal!

 

If you're in Hangzhou - where the G20 is - there won't be a need for you to do anything.. they'll do that themselves!

 

If you're not, it's unlikely much would come of it. You could try contacting the PSB or SAFEA, but... TiC.

 

And no need for an undercover cop... all they have to do is raid the place and ask for passports! Or see the license.

 

I don't entirely agree with Hots above. Nor with you, OP. Are those teachers actually able to teach English? Are they competent speakers? Has the company lied to them, and they are here under false pretenses?

 

Personally, if the 'teacher' sucks arse - then yeah, get them kicked out. But if they're illegal due to crap technicalities, I'm less inclined to give them the boot!

 

You're sounding more like a wumao than a concerned teacher (given your hasty accusations...),

Do you expect to get a pat on the head from the relevant authorities when you report to them like the good little dog that you are? Good luck. I doubt they'll even listen.

If I were you I'd worry about myself first. Maybe a little bit of reflection on why you feel the need to report people to authorities and possibly ruin their lives when it's really none of your business.

Your English is terrible. I doubt that you are a native speaker of English. So you are either a native speaker of English who has a tenuous grasp on his/her own language or you are not a native speaker, therefore cannot work legally in China unless you gained your degree from a native speaking university. I happen to be a native speaker who has a degree in education from a good university. I'm a licensed teacher so I can teach legally in any country in the world.

Ok, lets say you do report them, nothing will really happen to them, after they are fined or released well than something much worse would happen to you, you just made enemies, they need to survive and if handling you is how they keep surviving than they will handle you the Spain pain way or the bar Brazil way, woo you don't wanna know what people from France will do to you when they are angry, so don't make enemies in China man, they would find out who ratted on them, so do you really want to keep looking over your sorry a** shoulder? Oh, the company would also pull some sneaky moves on you, maybe with a quick release. No company making a buck wants a snitch in it, yes of course the PSB will report to the company who reported the so called illegal workers.

Simply because they're from non native countries? You clearly know absolutely nothing about China. Some cities have their own policies. I worked at a school that legally employed Africans and Filipinos. 

Next, you don't see enforcement because the official responsible takes bribes from the schools, so go ahead and report them, give your name and other information. After reporting them you better have a plan to leave the city and you'd  better make sure all you t's are crossed and your i's dotted, because they will look into you with a fine tooth comb. 

People who need others to suffer for their own benefit are truly losers downright despicable.  How China enforces its rules is China's business.

Stay safe, he doesn't know that if someone who is not Chinese kicks his a** to the near fatal stage, Chinese will only walk by and take wechat ahd weibo pictures. Some young men in their 20's still need some reminders that China won't help two foreigners who had fight IF they both made to the police station.

None of that liberalism on steroids will be available to come to their aid.  In America, or your recent example of the EU, on the other hand, Excessive liberalism will be ready to come to the defence of those who are both illegal and also desecrate local laws.  You will see multiple offenses done by scum who never get sent out.  Half of the backlash against illegals ( in America, EU, China, perhaps other places) is against the bad apples of whom nothing is being done about.  They ruin it for all the others and the controversies are created when nothing is done about them. China doesnt have this problem because they actually dare to put the bad ones on a plane and force them to GTFO. Hence, an answer to your question of why nobody is complaining about those people is because they don't really need to. The police are pretty responsible here when it comes to getting rid of the bad ones.

But I've got no idea what you're going on about with China not having that problem... Law enforcement at the best of times, is pretty lax (and petty). There's always something (and someone) illegal going on and being blatantly ignored as too much effort. In fact, I'd suggest that 90% of the problems we have here is this ignorance of basic law enforcement (and the subsequent follow-on effect of disregard for any laws, rights, contracts, etc).  Money >Face>Family>integrity

I don't think that China has this problem anywhere near to the scope of which other countries do.  Because whether or not you believe the police force is lax or not,  they are notably tight when it comes to visas.  Let's remember that visas are circumstantial and that they tend to expire every year for a lot of people, meaning that in order for them to renewed, the applicant needs to have a good record and be in good graces of the company he/she is in. If it is a troublemaker who has had previous run ins with the law, you can be sure that this aspect will be scrutinized.

In SE Asia, if a school is operating illegally, usually its one or more of the other legit schools in the area  report it in to whomever. To be honest, that would be expected b/c who wants illegal competition around (which usually charge less than the legit ones). As for China, idk.

i have mentioned this on the board many times and some people dont read previous answers,

It is very common for psb officers children to get free english lessons at training schools in return for a quid quo pro on visas for their teachers.

This happens all over china, nothing can be done about it. TIC

You wouldn't happen to have a super interesting backstory of a disillusioned, sole survivor of an elite unit that was double crossed while having served behind enemy lines, or something similar, would you? Turned off by the wrongs in the world and becoming a vigilante, but in a country far far away....

Before you go reporting people, you need to make sure you are legal yourself.

How to do that? I have no idea.

You might have a Z visa and RP, but I would say there is more than a good chance that your visa was obtained via illegal means.

I don't mean you personally, but your school. Do they have a license to employ you, or do they just pay another establishment to use their licence?
