...They are trained at the Tsinghua judicial college by Harvard Law professors? Why would they want to be schooled by the best lawyers but feel know need to be lawyers themselves. Do the fear they might not pass the Chinese Bar exam which 85% of law students fail?
Chinese Judges being trained by foreigners is a huge improvement to the times when tey were just random people who possessed enough guangxi to get these powerful positions.
The judges training is less important in a country where there is no rule of law. Without rule of law, judges are just puppets of the regime.
And yeah, this was not news to me
expatlife26:
yeah that's what I always heard it was. Like literally just random assholes zero official qualifications required at all. And this was from a local lawyer friend!
If that's true definitely a step in the right direction.
Not only that, but also there is no jury at trials either. The judge has ne or two "assistants", who perform the duty of jurors among other things.
As said above there is no rule of law in China anyway, there are many cases in which one party was clearly innocent but got condemned because the other party has good guanxi.
One simple advice, do it yourself, if someone is causing you troubles in China and won't listen to you or calm down, man up and beat him down, then get out of the country, foreigners never win in Chinese courts.
I just found out that cases involving government officials must be sent to a special CCP committee for "consulting" before the judge announces "his/her" decision! Also, unlike the West Chinese judges do not have to give reasons for their decisions. How convenient.
