a new employers wants me to get a background check from China. How would i apply for one? I do not have the FEC because my old employer is holding it. AS they are in the process of cancelling it I doubt i will have access to it.

I was able to have a friend get a check for me in Minnesota with a notorized letter including my full name and proofs of identity (SSN, D/L Number, plus photocopies of same). I suspect most US states offer the same service.
If it's for a work permit, you probably need it from your home country. If you need it from China, go to your local police office (Where you are registered)

I've never heard of a Chinese employer needing a Chinese background check, I mean if you get done for something in China you'd probably be kicked out. I do know a guy who went home and needed to prove he had a clean in China for a job he applied for there. He contacted the police station where he was registered in China and they pretty much ignored him, wouldn't do a thing to help. I'm sure if you're there in person bothering them though they'd be able to.
