Sign up with Google Sign up with FacebookA lot of legitimate companies won't be able to hire you without one. Basically the letter releases them from any non-competition agreements that might be in place. Without that letter, they are opening themselves to potential risk.
It's not even so much about the companies, it's about the PSB. The release letter shows that A.) you've completed your contract and fulfilled your obligations and are now able to be employed by another company, or B.) a separation agreement was made outside of your contract and you have no further obligations mutually agreed upon between you and the former employer.
Please note, this usually only matters in you <b>don't</b> leave China. If you leave and get a new visa, they probably won't ask for it.
Keep in mind, that even if you quit (or "resign") from a job, the company is legally bound to provide you the document. It only needs to say "So-and-so resigned from his/her position at name-of-company on this date" and have the company chop on it.
If your employer doesn't provide this, speak with the PSB and inform them that you quit or what have you and WHY. Contract violations, being ripped off, withheld pay... Or, simply remind your employer (assuming you have your residence permit - NEVER let a company hold that or your passport under any circumstances) that THEY are ultimately responsible for you here in China, as their name is on the document and it's in their best interest to remove themselves from that liability. All the need to do is chop a piece of paper with one sentence on it.

They want to cancel your visa because that visa says they are responsible for you. If you are no longer working for them, then they should not need to bear that responsiblility.
I'm suing my employer for back pay. Release letters are tricky where I'm located. We actually have the SAFEA leaders of my city involved. Apparently, the company also provides a recommendation/complaint document to SAFEA in addition to the release letter that you will never be privy to. I got that info directly from SAFEA (probably bribed). If the recommendation says anything bad, SAFEA won't issue you another FEC for 2 years.
Technically the other poster is correct. A release letter is equal to a contract to dissolve your contract. It should be signed by both parties and it needs to have the stamp from the company printed on your FEC in order to be valid. (A lot of dual contract scams in China). Training schools are notorious for scams. Actually, the FEC is more important than the release letter. You can use it as a bargaining chip. Finally, if they get nasty, all you really need to do is threaten to notify the Social Insurance bureau for not providing you with social insurance. It's a nightmare for them.
What if the company will not issue the release paper to the employee? What the employee can do about this?

Dial SAFEA (Foreign Expert Bureau) and ask them for help.
By Chinese law, employer is required to submit RL and FEC cancellation certificate in 30-days after your last working day.
If you wanna switch jobs or work in China again the release letter is the most important thing.
