In the UK we would be able to call the police and file a complaint against someone who beat you up and start a court case for damages... I have been threatened several times now and my colleague (who is Taiwanese) was heated badly by an ex-ployee who was dismissed due to his poor work. He then returned with friends and beat him up. He is also one of my good friends and I introduced him to the company and feel really bad that he has been beaten up for helping me. I am from England and have been in the Nantong, Jiangsu area for over 5 years. I employed my friend as General manager as he could speak Chinese and had experience also in this area of China although he grew up in Thailand.
We called the Police and they came eventually, but I have no idea of the law and how to deal with this. I want the offender to be punished legally and pay for his crime, but whether this is possible knowing the cultural differences and local Guanxi ties, I fear we are not going to get a satisfactory ending.
Any comments are appreciated.
yes you can sue him for the damages ,but is he rich enough to pay the compensation ?
about his punishment : he will be punished severely by the court , as he has commited two crimes : one beating your freind and the other is damaging china's image ...
He's actually not rich, but it was mainly the punishment in terms of arresting him and how we stand. Thanks for your answer anyhow, it appears we have some positives to come out of this.
Nantong use to be a great little city. There was a high percentage of foreigners there, and a good social life. Unfortunately, many of the good people left because the shipyards cut back due to world economy. However, many illegal foreigners from a particular bar that promotes a culture of binge drinking and sexual harassment have caused a lot of angst amongst the locals. Not Nantong specific; it happens everywhere.
I think the police will act in Nantong, as there is a foreign business owner/manager involved. They would like to keep the good foreigners. There are still a lot of good people that Nantong would like to keep, as well as the ones they simply can't get rid of. Just in case, contact the Nantong Mediation Centre. They are a free service to assist foreigners in these sorts of situations. They are English speaking lawyers, and have good guanxi.
Are both parties your friends?
If you are from England, do you not know that if someone treatens you that you SHOULD head butt him? Then stomp him. Don't take crap. If you lose then you lose, get it over with.
Who has time for police and courts.
remember where you are get in a car wait for them to cross the street drive really fast and run them over, people will leave them in the street to die and if it ever traces back to you , just say you did not notice and everything will be ok
