Q: Leaving school. Should I be careful about something?

I am leaving my current school for a better opportunity. Any advices? Anybody had bad experience with good school after you resigned?

You should write more about your visa 'position'!

No repercussions on F visa! You're illegal worker (if you receive salary to your bank account), and you cannot expect help from Chinese Gov. (FEB). However, if you're legal worker with Residence permit, you must 'full fil' few demands from your present employer!

Add-it your Q, and write your Chinese visa status, for detailed answer. 'Lawyer's' talk here!surprise

If the school you're in doesn't suit you or didn't live up to expectations, leaving is a logical choice. Just make sure you leave peacefully so that you get all the documentation needed. The next school you go to (assuming you are going to one) should not have the same things you experienced before. By the way, didn't you choose Qibo over another school? Maybe you could share your experience with people here so we would all know what to look out for. Meantime, good luck on your next gig!

What is Qibo?

Ha ha, thanks icnif77. Business visa here. I hope your counseling is not too expensive? LOL

icnif77:

It's free! I enjoy this board!

You can leave School with F visa anytime you desire. Why?

Both, you and your employer are against the Chinese Law, so Contract you signed is not valid!

Some employers want to keep your passport (while on F), so you can't leave 'tomorrow'! Against Chinese (or any country's) Law, again!

You must seek help of your Embassy to retrieve passport.

If you hold your book, you can go elsewhere tomorrow! You need Release letter from your present school only if you want to extend Residence permit (Z visa).

I just checked again. . Passport is in my pocket. So no worries, but I want to be fair and stay in the school according to non-valid contract which stated 1-month prior resignation notice. They asked me if I could give them more time 2-months, so I accepted.

I agree! Do as less damage as you can to the School! But, Contract you signed isn't binding, because F (illegal, by Chinese Law).

I was looking for my FT replacement to School in Dalian. (tread here somewhere).

I resigned, because School made me work 2.5 H/month more than Contract stated. 'I'm too tired' was my reason on Resignation notice!

I'm working with Z (Residence permit).

FEB made them issue all necessary documents and last salary!

If they give you a release letter everything is OK.

If they don't, it isn't.

And I'm assuming you've finished your contract, because if you haven't you won't get a release letter.

icnif77:

Not right (despite nice 6-pack!). Working under F is illegal by Chinese Law! Contract you (he) signed is not valid! No need for 'Release letter' on F.

If your on a business visa. There is almost nothibg they can do. Other than hold your salary. Of course if they really hate you they could try stuff but you sound like its just a better opportunity. So no point burning any bridges. Just politely leave and youll be fine.

Actually school was good. I am leaving for a much higher salary (non-teaching job).

I will stay 1-2 months in this school until (if) they find a replacement.

Only bad thing which I didn't mind was that they didn't tell me that they will reduce my salary for Chinese New Year, because we started to work on February 19. So they pay me 9 out of 23 working days, but I figured it out myself because contract had information that they pay 3 days for Chinese New Year.

And contract stated 40 working hours in a week but actually I worked 44 hours/week.

And on office hours I had to stay in school but I had the possibility to surf the net on my laptop. In the beginning it was OK, because on office hours I was learning about their teaching program but after I learned it all I just felt boring and useless sometimes. I thought I could use my time better.

WCG:

Let us know if you get your last month's salary.  I am seriously considering the illegal route with my next job.  I kind of like the illegal "employment at will" status.  The school has too much power to hold your release documents if you are actually legal.  I was legally employed at the training school I worked for last, and they've been real nasty.  I've been forced to fight fire with fire in response and I'm actually winning right now, but it's long and time consuming.  Police, labor bureau, social insurance bureau, and SAFEA are all involved.  Still haven't got the release letter and now we're going to mediation.  Filed on Thursday.  I'm asking for around 40 thousand in unpaid salary and housing allowance.  The company is the infamous "H" with an amp and a son.  I should have done more homework before signing on with those guys.  Probably going to switch to a family visa and find a couple part time gigs, "at will" sounds like the way to go in China.  I hate being someone's bitch.

I guess you wouldn't be able to tell us what school was that one so I won't ask you for it. As Louis told you already you should go on a peaceful terms with them. It's good that you have a positive perception about them because for the time you're to stay there, up to 2 months until next replacement, they may try to make your life enough to repent for teaching there.

I guess the school is a kindergarten. If so, then you must have reasons enough to enjoy your job until you leave.

viango:

If you need the school info, it is no problem for me to give it to you. I think they are aware that I could walk out on them, because I already told them that in new job I get salary per day and because staying at school I can work only for 2 days a week. In new job 2,5 days earnings is equal to school monthly salary. When I stop working at school I will increase my working time to 4 days a week and I told them this.

So they are clever enough to know, bad behavior to me and I am gone. If they stay nice like they always were, I will stick with them until they find replacement.

Compared to stories that I read here my school is heaven on earth. They were always very helpful about finding me an apartment, helping me to arrange internet, if I need to travel somewhere they would buy train ticket for me online, invite me to social activities outside school, dinner, billiard, etc.

I would like to know what school is. If you care to let me know you can private message me. Anyway, keep a positive altitudes with them, because it looks they were nice to you and they have treated you well. Friendship in China is a miracle and when it happens you don't want to lose it. So make them your friends, if you can.

I have a bad experience but it was hilarious. The recruiter for the school (a infamous Frank Zhang, maybe some of you heard about him) claimed he found me for a school in Suzhou when actually he didn't. I just happened to contact him about a different position and contact the school on separate occasions and he thought we swindled him...

Anyways, the school was beautiful and the students, awesome. The management... as usual... was just horrible. The students even warned us to get out while we could (you KNOW it is bad when the students warn you). So we told the management and made amends and left. The recruiter setup a website and stated that I did a midnight (more like 3pm from a taxi with the help of the school staff) runner with my lying wife and that I was beating people up or and trying to seduce female students.

It was ridiculous, but that's how they sometimes roll in China. Back home, I knew some people that I thought were amazingly shameless liars... and then I came to China. I didn't even know humans were capable of such ridiculous malicious acts of lying, I never even met the guy in person. Chinese certainly know how to hold a grudge so be wary.

The only real bad thing they could do would be to inform the relevant authorities that the new school has someone working for them illegally. However, that new school is probably bribing the police to look the other way, so it's unlikely anything really bad will happen!
