Q: My Chinese boss says I get an internship payment - but the girl who helped me said I don't

Hello,

I'm in Qingdao, China at the moment and I will work after the holidays for a ship company.
I'm a German student & he said while I did an Skype interview with him I'll get a payment.
But now when the girl picked me up from the airport she said it isn't allowed.
I've contacted my boss on WEChat & he said he has asked her & he said again I shouldn't worry I get a payment from her.
I guess she is cheating on me right ?

Lots of greets and thank you for help

Employment law states that Foreigners doing an internship in China must be paid a minimum of 1000RMB per week and have free provided accomodation.

If you want that money make sure you sign a contract with your boss, NOT WITH THE GIRL!!!, the contract must clearly say how much you are getting paid and also you have to be on the right visa (whatever it is for interns nowadays) to enforce this contract.

The girl who "helped" you might be trying to pickpocket the money that was budgeted for you by the boss, if you are paid through her or the agency she works for, this is very likely the case.

Ask your boss to bring you to the bank and open a personal account, it costs 5 yuan and then he can pay you directly.

right on. That's probably what this guy is worried about.

Per week???

That deal is better than some teaching jobs! Especially at universities in the far-flung reaches of this empire.

Also, please provide a link for this... it runs contrary to everything else I've ever seen.

What airport? And why is it not allowed?

Payment from who for what?

Him or her.

Who is cheating who?

What is your question?

Honestly.... what is your question?

expatlife26:

I don't understand your confusion scots, seems pretty straightforward even if the english isn't standard.

They guy signed up for an internship that probably had some kind of basic salary according to the boss, now he's talking to somebody there who is saying there is no compensation.

He's asking if we think the girl is trying to steal from him/the company

If the company is providing a salary but whoever this woman is attempting to pocket the salary herself by claiming to him it's an unpaid internship.

May be the girl don't know it, you should show her your Wechat msg with her boss, or just talk to boss when you go to the office and make all clear like how much you will get,how will you get in your bank account or just direct cash whatever it is. The girl would have no choice to deny it when boss ask her to do it in front of you.and if boss did confirm with you on wechat and you have msg than the boss will do it for sure in order ‘to not loose his face.'

The girl is probably trying to cheat you. I recommend having your boss open a new bank account in your name and just pay you that way.

Be vigilant, Hendrik.  Cheat and lie, that's what they do...and they'll go to the enth degree to see the cheatery and liery through.  But don't necessarily let this info stop you.

All the best with it.

First of all, what visa are you on? Also, have you been given any kind of contract where your salary payment and work period has been stated?

If it hasn't been stated on any contract and you're working there on a tourist visa then your colleague may be on to something there..

When you write "I'll get  a payment", it sounds very much like you haven't discussed all the details, and you don't even know how much you'll get...

What about other things, like accommodation? Food? Relocation/flight expenses? etc?

However, TIC - and that means, so many times, that people have absolutely NO idea on what should and shouldn't be done, can and can't be done... and just say 'no' cos it's a lot easier, and ends up expending more effort than saying 'yes'.

So - maybe she doesn't know, and everything is ok with the boss. Maybe she does know, and the boss is going to rip you off... Either is possible.

Who arranged your internship?

If it's the guy, then you should be paid UNLESS the girl is trying to warn you that you've been scammed.

If the girl arranged your internship, then maybe she is attempting to keep the money that you're supposed to be paid.

Try clarifying your details a little.

For foreigners nothing is called internship in China , it's work and you get paid for it.

Shining_brow:

Except, of course, for all the internships that many foreigners come here to do...

Sheesh! What's your definition of 'intern' such that it's not a form of paid employment on a short-term contract (with no expectation of renewal or continuation), with the specific understanding that a reduced wage is paid due to lack of experience.

In my city, there are LOTS of interns from OS.

Thank you very much :)

Yes I have a company who said in my company I will get a payment on the skype interview. So the girl who isn't in a company & just arranges my internship ( so I'll keep in contact because my Chinese isn't very good - I want to learn more ) I will stay here for a 1/2 year in Qingdao.

I will talk to the women. I think it is very unfair. My chinese friends in Germany also said the same that she's cheating on me.
Otherwise I will go to the police with a friend.
Furthermore, she said I don't need a Chinese Z visa I just need a X2 Visa because it's cheaper.

Thank you very much.
I believed in her because she said she is doing these internship works for foreigners a long time ago.
And I saw on the internet lots of different companies.
http://jobmarket.china.ahk.de/employer/view/4767/

thanks for help & have a nice Sunday.

Shining_brow:

"I just need a X2 Visa because it's cheaper."

Because it's "cheaper" is NOT a valid reason for having a different visa!

This could be useful - see sections 14 & 15 - though I don't have a date for it

A:Good question!  I'd say, if you study at Uni in China beside working full-time as an E.T. with Residence permit, you don't interfere with your full-time employment. It's your free time and you can do anything you want, with respect to the Chinese laws and customs. Have a look at terms of Z visa/Residence permit and ... ".. you cannot work (and earn monies!) with another employer ..."That's all it is! Your RP sponsor title is written on the RP stamp in your passport, I think. It's in Mandarin, so I've heard about that from someone ...At I.D.-ing by cops, they know where you work and than more details about you are just a phone call away ... and it happened in person ... LOL ... during the day-time stroll through Wulumuqi, Xinjiang, 2012/13 semester. Now under RP, you're free to surf Internet, jog, ... and study, too. I suggest, you look and ask at the Uni, you plan to study in the future. Have a detailed look at requirements for studying and attending chosen Uni.Good luck! -- icnif77
